Determining Child Support Payments In New York

The goal of New York’s child support guidelines is to provide children the same standard of living after divorce they would have enjoyed if their parents had remained married. The guidelines are rigid and often provide little room for upward or downward variations.

What Are New York’s Child Support Guidelines?

New York law bases child support on the parents’ income and the number of children supported. The guidelines are as follows:

Number of children Percentage of income paid as child support
One child 17 percent
Two children 25 percent
Three children 29 percent
Four children 31 percent
Five or more children 35 percent

As of January 1, 2017, the above percentages apply to the first $143,000 of earnings each year. The court may apply a lower percentage for income above $143,000.

The guidelines take into account other children you support. However, you will have to prove to the court that the children are yours. You will also need proof of a child support agreement, such as a court order.

How Is Child Support Determined?

Child support percentages are applied to almost of the payer’s income. Among the few credits from the income for purposes of determining child support are state and local taxes, and verified support payments for other children or other spouses.
